DALTON, Georgia (WDEF) – Dalton investigators have decided not to file charges against the driver involved in a fatal pedestrian struck.
April Alesi of Newnan, Georgia was crossing Chattanooga Road last Thursday evening when she was hit by a pickup.
Police say Alesi’s blood alcohol content was 0.42, or more than five times the legal driving limit.
Investigators determined she stepped out in front of the pickup and was thrown about 15 feet when she was hit.
The driver said he saw Alesi looking away from him when she stepped into the road.
But the investigation didn’t let the driver completely off the hook.
Officers found a jar of marijuana in his car.
So Edward Lamar Cook of Dalton will face charges of possession and intent to sell.
Still, they say the marijuana was not a factor in the crash.
