North Carolina Will Not Charge The Man At The Center of a Mountain Feud

     A D-A in North Carolina has decided not to charge the man who fired the first shot in a mountain revenge plot.
     This all started two weeks ago at a weekend home on Boiling Springs Road in Cherokee County North Carolina.
     James McKinley shot Gregory Abernathy dead during a struggle.
     Now officials have decided he was just defending himself from a trespasser.
     The sheriff says Abernathy drove his ATV under a gate, that was clearly marked "no trespassing."
     McKinley fired warning shots from his porch and ordered him off the property.
     But Abernathy came at him and tried to take way his gun.

    Two friends of the man who was shot do face charges in the case.
     The Sheriff says days later, James Millsaps and Dallas Carringer planned to shoot McKinley in revenge.
     But they wrecked on the way to his house.
     Carringer kept going on foot, but didn't find anyone home.
     So he burned the house, according to investigators.

    Carringer faces an arson charge in addition to conspiracy to commit murder.
