Does your landlord have the right to ban guns in your home?

According to Tennessee's attorney general he does.

"We aught to be able to control what happens on our property and who rents our properties and what they do while they're there within limits and degrees," says landlord David Noblit.

Noblit has dealt with tenant issues for nearly 20 years.

He doesn't have a problem with license guns, but says he has every right to ban them if he chooses, "We have no pet properties. We have no smoking properties. We have properties with no junk cars. We don't want loud music a lot of times."

Tennessee's Attorney General says it goes even further than that...

In an opinion released Wednesday the AG says landlords can include a firearms ban in the lease or through posted signs.

State Senator Andy Berke says it's about the landlord's right to control his rights, "When it comes to invading people's property rights and saying you can't stop people from doing what you want on your own property that is something that we have to think twice before we do."

Gun enthusiast Bill Selby doesn't deny a landlord's right to ban guns...but says he wouldn't live where he couldn't have his guns, "I either wouldn't rent there. Or I'd just bring it in and they'd never know. It's not like they're gonna search my apartment or anything."

The Attorney General's legal opinion is just his office's interpretation of the law...

Unlike court opinions, it isn't legally binding.
